1. General provisions

  1. The Newsletter entitled "TME Newsletter" is issued by Transfer Multisort Elektronik Sp. z o.o. with its registered office in Łódź at ul. Ustronna 41, 93-350 Łódź (Poland), entered in the Company Register by the District Court for Łódź-Śródmieście, XX Department of the National Court Register (KRS), under KRS number 0000165815, with initial share capital of PLN 3.300.000,00, NIP 729-010-89-84, REGON 473171710 (hereinafter referred to as TME).
  2. The subject of the TME Newsletter service includes sending by TME free of charge, via electronic mail, in a regular manner, but no more frequently than once a week, after obtaining user's consent, to an e-mail address specified by the Service User, an online newsletter containing information on offerings from TME and its subsidiaries, events, and other information related to commercial activities of TME and its subsidiaries (hereinafter referred to as TME Newsletter), in accordance with provisions of these Regulations and applicable law.
  3. TME Newsletter can be subscribed by any natural person, legal person or organisational unit not having legal personality (hereinafter referred to as the Service User or Subscriber).

2. Ordering the TME Newsletter service
TME Newsletter service can be subscribed with the use of:

  1. Registration form
  2. TME homepage
  3. The "Your account" -> "Newsletters" tab

Ordering the TME Newsletter service with the use of the Registration form
To subscribe to the Newsletter:

  • Go to the web service: tme.hk
  • Click the "Register" button on the homepage
  • Fill-in an appropriate registration form and provide consent to receive the e-newsletter
  • Submitting a registration form and receiving a confirmation of account activation implies the establishment of an agreement with TME for the provision of TME Newsletter

Ordering the TME Newsletter service from TME homepage
To subscribe to the Newsletter:

  • Go to one of the web service: tme.hk
  • In the Newsletter section of the homepage, enter your e-mail address and click button with an arrow
  • After proceeding to the details section, in the field provided enter captcha codes, give consent below that field and click “send” button
  • Clicking the link in the e-mail confirming your request to receive subscribed materials implies the establishment of an agreement with TME for the provision of TME Newsletter

Ordering the TME Newsletter service from the "Your account" tab
To subscribe to the Newsletter:

  • Go to one of the web service: tme.hk
  • After logging in, go to "Your account" -> "Newsletters"
  • Choose if you agree to TME Newsletter terms
  • Clicking the link in the e-mail confirming your request to receive subscribed materials implies the establishment of an agreement with TME for the provision of TME Newsletter

TME obligations related to the provision of the TME Newsletter service result exclusively from these Regulations and applicable law.

3. Processing personal data of the subscribers
Subscription to the TME Newsletter implies the ordering of the TME Newsletter service, which includes giving consent to the processing of personal data (e-mail address) by TME as data administrator, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR)

  1. Personal data provided by the Subscriber (e-mail address) shall not be shared with any third parties, except the operator of the IT system used to provide the TME Newsletter service and  Shenzhen TME Electronic Trading Company Ltd. – TME’s Chinese subsidiary, which supports us in issuing Newsletter, nor used for any other purpose than to provide the TME Newsletter service.
  2. Revoking the consent for processing personal data by TME means that the User resigns from receiving the TME Newsletter service defined in these Regulations. To remove your e-mail address from the mailing list, follow the procedure described in section 5.
  3. In order to ensure high quality of services, TME has prepared the Privacy Policy containing information on i.a. the conditions for processing personal data by TME.
  4. Your data will be transferred to People’s Republic of China, where TME’s Chinese subsidiary – ­ Shenzhen TME Electronic Trading Company Ltd., has its seat. The European Commission has not determined, that People’s Republic of China offers an adequate level of data protection. Therefore, we adopted appropriate safeguards within the meaning of article 46 of GDPR, by signing with Shenzhen TME Electronic Trading Company Ltd. standard data protection clause adopted by the Commission in accordance with the examination procedure referred to in article 93 (2) of GDPR. 4. Conditions for the provision of the TME Newsletter service

  1. TME directs its correspondence to an e-mail address specified by the Subscriber of the TME Newsletter as the address to which the TME Newsletter shall be sent.
  2. To be able to use the TME Newsletter service, the Service User is required to have an active and properly configured e-mail account, and a computer with access to the Internet.
  3. Each issue of the TME Newsletter includes:
    • Information on TME as the sender
    • The contents
    • Information on cancelling the TME Newsletter service

The Service User who decides to subscribe to the TME Newsletter agrees to receive marketing materials via electronic means in accordance with Art. 8.1 of the Act of 18 July 2002 on provision of services by electronic means (Journal of Laws of 2002, No 144, Item 1204, as amended) in the form of TME Newsletter.
The contents of the Newsletter is protected by law, and Subscribers are not authorised to use it for any other purpose than to get acquainted with the contents.

5. Cancelling the TME Newsletter service

  1. The Customer can at any time cancel the TME Newsletter service.
  2. The agreement for the provision of the TME Newsletter service can be terminated in the following manner.
    a) on one's own, by removing Subscriber's e-mail address from our mailing list
    For this purpose:
    1.  Go to one of the web service: tme.hk
    2. Go to the homepage:
      1. In the "Your e-mail" field enter the address you want to remove
      2. After proceeding to the details section, in the field provided enter captcha codes, choose that you want to unsubscribe Newsletter and click “send” button
    3. After logging in go to the Newsletters section on the "Your account" tab
      1. Choose that you want to unsubscribe Newsletter and click “send” button
    4. After that click the link provided in the e-mail message, results in the removal of the indicated e-mail address from the TME Newsletter subscriber database
  3. b) by submitting a request for removal of an e-mail address to [email protected]. To do that, the Subscriber needs to send the request for removal using the address that is to be removed.

6. Complaint procedure

  1. The TME Newsletter Subscriber is entitled to submitting a complaint in relation to the TME Newsletter service.
  2. Complaints shall be sent via e-mail to: [email protected] , no longer than within 7 days from the date of the event serving as the basis for the complaint. Complaints submitted after that date shall not be considered by TME.
  3. A complaint shall include: e-mail address of the person submitting the complaint (to which the response shall be sent), the contents of the complaint with explanation, and a proposed solution of the situation.
  4. Complaints shall be addressed within 14 days from the date of receipt. Response to a complaint shall be sent to the e-mail address used for submitting the complaint.

7. Final provisions

  1. These Regulations enter into force on the day of their publication on TME website.
  2. TME may introduce changes to these Regulations at any time, in particular to update the contents to reflect any changes in the procedures adopted by TME. Any changes introduced in these Regulations become binding upon publication on TME webpage.
  3. TME reserves the right to terminate the agreement for the provision of the TME Newsletter service concluded with the Subscriber, subject to seven days' notice.
  4. Should the Subscriber breach the provisions of these Regulations or applicable law, TME is authorised to immediately cease provision of the TME Newsletter service.
  5. Any legal relations arising from the Regulations are governed by Polish law. Any disputes shall be settled by the competent common courts.
